EPA’s “Affirmative Defense” Air Policy Under Attack
December 23, 2013 6:16 pmThe Environmental Protection Agency (EPA) has an affirmative defense policy that allows industries to be exempt from some clean air emission limit violations if the violation is not avoidable, accidental, or caused by equipment malfunction. Environmentalist believe that the policy is unlawful under the Clean Air Act (CAA) because industries can use the policy as an excuse to get around the emission violation.
